1. Introduction
Boat Work (“the Agency”) specializes in marine recruitment services, connecting qualified maritime professionals (“Candidates”) with reputable companies (“Clients”). By using our services, both Candidates and Clients agree to the terms outlined below.
2. Services Provided
The Agency provides recruitment and placement services, matching Candidates with Clients based on skills, experience, and requirements.
The Agency does not employ Candidates directly; they are employed by the Client unless otherwise agreed in writing.
3. Responsibilities of the Agency
To act as an intermediary between Clients and Candidates with diligence and transparency.
To ensure Candidates meet the minimum qualifications and certifications as required for each placement.
To maintain the confidentiality of Client and Candidate information, as outlined in our Privacy Policy.
4. Responsibilities of the Client
To provide accurate job descriptions, requirements, and working conditions for the placement.
To adhere to applicable employment laws and provide fair and safe working conditions.
To pay all agreed fees to the Agency as per the invoicing terms.
5. Responsibilities of the Candidate
To provide accurate and truthful information regarding qualifications, certifications, and experience.
To meet the requirements of the role as described by the Client.
To comply with the terms and conditions of employment set by the Client.
6. If You Are Not Satisfied with Our Service:
Step 1: Clients and Candidates should first contact the appropriate person responsible for complaints as outlined in the company’s Safety Management System (SMS).
Step 2: If the matter remains unresolved, please contact the Agency directly by emailingcrew@boatwork.uk
Step 3: If you are still not satisfied with the resolution provided, you may escalate the complaint to the Maritime and Coastguard Agency (MCA) at MLC@mcga.gov.uk.
7. Fees and Payment
Clients agree to pay recruitment fees as agreed in the contract with the Agency.
All invoices are payable within 14 days of the invoice date. Late payments may incur additional charges.
8. Liability
The Agency does not guarantee the suitability, performance, or continuity of Candidates beyond initial vetting.
The Agency is not liable for disputes, damages, or losses arising from the employment relationship between Clients and Candidates.
9. Termination of Services
Either party may terminate the agreement by providing written notice as per the terms of the contract.
Fees already incurred remain payable in full upon termination.
10. Confidentiality
All information shared between the Agency, Clients, and Candidates will remain confidential unless disclosure is required by law.
11. Governing Law
These Terms and Conditions are governed by the laws of the United Kingdom and The Maritime Labour Convention, and any disputes will be resolved under its jurisdiction.
12. Amendments
The Agency reserves the right to amend these Terms and Conditions. Updated terms will be communicated and published on our website.
13. Acceptance
By engaging with the Agency, both Clients and Candidates acknowledge and agree to these Terms and Conditions.
